These Terms of Service (the "Terms") govern your use of the website www.vespera-sleep.com and related services provided by Vespera Sleep AS ("Vespera", "we", "us"). By using the website, you agree to these Terms. If you do not agree, you must not use the website.

When you purchase products through the website, our separate Terms of Sale also apply. Our processing of personal data is governed by our Privacy Policy. These three documents complement each other.

1. About these Terms

These Terms apply to all users of www.vespera-sleep.com, including visitors, account holders and customers. Nothing in these Terms limits your mandatory consumer rights under Norwegian or EU/EEA law.

3. The service

Vespera operates a direct-to-consumer online store for natural latex mattresses, sleep systems and related bedding under the Aether brand, manufactured by Greensleep (International Bedding BV, Belgium). Vespera also offers complementary guidance services — including the AI Sleep Blueprint, Sleep Impact Reports and integration with sleep-tracking devices (such as Oura and WHOOP) — which together form what Vespera refers to as the 110% Sleep System.

Vespera reserves the right to add, change or remove features, products and services from the website at any time, save where a separate purchase agreement provides otherwise.

4. User accounts

Parts of the service may require you to create a user account. You are responsible for providing accurate and current information, and for keeping your login credentials (password, etc.) confidential. You are responsible for all activity carried out under your account.

If you suspect that an unauthorised person has gained access to your account, you must notify Vespera without delay at post@vespera-sleep.com and change your password.

Vespera may suspend or delete accounts in the event of material breach of these Terms or where there is reasonable suspicion of misuse.

5. Your use of the website

You undertake to use the website lawfully and in accordance with good practice. In particular, you shall not:

• use the website for unlawful purposes, including fraud, money laundering or identity theft;
• attempt to gain unauthorised access to the website's systems, servers or data;
• upload or distribute malicious software, viruses or other harmful code;
• extract, copy or reuse content from the website in a way that infringes copyright law or these Terms;
• use automated tools (bots, scrapers, etc.) to extract data from the website beyond what is permitted in robots.txt;
• act in a way that prevents or impairs other users' access to or use of the website.

6. Intellectual property rights

All content on the website — including text, images, illustrations, graphics, logos, trademarks, audio, video, software and design — is protected by copyright, trademark and related laws. The rights belong to Vespera Sleep AS or our partners and licensors, including Greensleep (International Bedding BV) for product-related content.

The trademarks Vespera, Vespera Sleep and Aether are owned by Vespera Sleep AS. No use of these trademarks is permitted without prior written consent.

You are granted a limited, non-exclusive and non-transferable right to use the website for personal, non-commercial purposes. Any other use, including copying, reproduction, publication or redistribution, requires Vespera's prior written consent.

7. User-generated content

If you submit content to the website — for example product reviews, comments or images — you grant Vespera a non-exclusive, royalty-free, transferable, worldwide licence to use, reproduce, adapt, publish and distribute such content in connection with our business, including for marketing purposes.

You warrant that you have all necessary rights to the content you submit, and that the content does not infringe third-party rights or applicable law. Vespera reserves the right to remove content considered inappropriate, unlawful or in breach of these Terms.

8. Links to third-party websites

The website may contain links to third-party websites not operated by Vespera. We have no control over the content or practices of such sites and are not responsible for them. Your use of third-party websites is at your own risk and governed by the relevant third party's terms.

9. Wearables and third-party integrations

Parts of Vespera's services (such as the AI Sleep Blueprint and Sleep Impact Reports) may integrate with third-party services such as Oura, WHOOP or similar sleep-tracking devices. Such integrations require your consent to the sharing of data between the services. You are responsible for your relationship with the third-party provider, including understanding and accepting their terms and privacy policy. 10. Availability and changes

Vespera aims for high availability, but does not guarantee that the website will be uninterrupted or error-free. The website may be unavailable from time to time due to maintenance, upgrades or circumstances beyond our control.

Vespera may amend these Terms. Changes that are to your disadvantage as a user will be notified with reasonable notice on the website, or by e-mail if you hold an account. Continued use of the website after changes take effect constitutes acceptance of the new Terms. You may stop using the website or delete your account at any time if you do not accept amendments.

11. Disclaimer and liability

The website and its content are provided on an "as is" basis. Vespera does not warrant that the information on the website is at all times complete, accurate or up to date, beyond what follows from mandatory law.

Vespera is not liable for indirect or consequential loss, including loss of data, profit or business opportunities, arising from your use of the website, save where required by mandatory law. The limitations do not apply in the event of wilful misconduct or gross negligence by Vespera, and do not limit your mandatory consumer rights.

12. Personal data and cookies

Vespera processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and Norwegian data protection legislation. See our Privacy Policy for full information on what data we collect, how we use it, how long we retain it, and what rights you have as a data subject.

The website uses cookies in accordance with the Norwegian Electronic Communications Act and the EU ePrivacy Directive. Details on cookies are set out in the Privacy Policy and in the cookie notice on the website.

13. Breach and suspension

In the event of material breach of these Terms, Vespera may, without prior notice, suspend or terminate your access to the website and delete your account. Vespera also reserves the right to pursue legal remedies and claim damages for any loss.

14. Governing law and jurisdiction

These Terms are governed by Norwegian law. For consumers resident in another EU/EEA country, this choice of law does not deprive you of the protection of any mandatory consumer rules of the law of your country of habitual residence (cf. Rome I, Article 6).

Any dispute that cannot be resolved amicably may be submitted to the Norwegian Consumer Authority (Forbrukertilsynet) for mediation, cf. the Terms of Sale clause 14, or referred to the ordinary courts. Consumers may bring proceedings in the courts of their country of habitual residence, and may only be sued in those courts, under Brussels I Recast (Regulation (EU) No 1215/2012), Articles 17–19.
